08 Feb Apeiron Scores Key Legal Victories
This week, Apeiron at the Jockey Club received several favorable rulings from the judge handling the litigation that was brought against our proposed project by the boards of Jockey Club I and Jockey Club II last year. While litigation is certainly not the path that the Apeiron team would have chosen, the judge’s recent orders are nonetheless a positive development.
On Saturday, February 4, Circuit Court Judge John W. Thornton opined in Apeiron’s favor on a threshold item in the lawsuit, ruling that a 1977 agreement on which the two Jockey Club condominium boards have based much of their lawsuit does not apply to Apeiron. Yesterday, Judge Thornton issued another order that is favorable to Apeiron and relates to property easements.
